1) Overview

This website (the “Site”) is operated by Curated Comforts (also doing business as Comfy-Cozy) (“Curated Comforts,” “we,” “us,” or “our”). We provide this Site, our online store, and related services to you (“you,” “your,” or “Customer”) subject to these Terms of Service (the “Terms”). By visiting the Site, creating an account, or purchasing from us, you agree to be bound by these Terms and any policies referenced here (collectively, the “Agreement”).

We may update these Terms at any time by posting a revised version on the Site. Your continued use of the Site after changes go live means you accept the updated Terms. If you do not agree, you must stop using the Site.

Our store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to sell our products and services to you.

2) Eligibility & Account

You must be at least the age of majority in your state or province (and legally able to enter a contract) to use the Site.

If you create an account, you are responsible for maintaining its security and for all activity that occurs under your login.

You agree to provide current, complete, and accurate information and to promptly update it (including email, shipping address, and payment details) so we can complete your transactions and contact you as needed.

3) Orders, Payment & Tax

Order Acceptance. All orders are offers to purchase and are subject to our acceptance. We may cancel or refuse any order at our sole discretion (e.g., suspected fraud, incorrect pricing, limited availability).

Payment. We accept the payment methods shown at checkout (e.g., Shopify Payments, major credit cards, Shop Pay, PayPal, etc.). By submitting a payment, you represent that you are authorized to use that method and authorize the charged amount (including applicable taxes, shipping, and fees).

Sales Tax. We collect sales tax where required by law based on the shipping destination and current regulations.

Quantity & Use Limits. We may limit or cancel quantities per person, household, account, payment card, or shipping address. Purchases for resale require our prior written approval.

4) Pricing, Availability & Promotions

Pricing & Errors. Prices, product descriptions, and availability may change without notice. We work hard for accuracy, but errors may occur. We may correct any error (including after an order is submitted) and cancel or refund as needed.

Promotions. Promotional codes and offers are subject to their stated terms, are not transferable or redeemable for cash, cannot be combined unless stated, and typically exclude gift cards and prior purchases. One code per order unless otherwise noted.

5) Products, Colors & Images

We strive to display products (including colors, finishes, and packaging) as accurately as possible; however, device settings, lighting, and supplier variations can cause differences. Dimensions and weights are approximations. Limited-run items may sell out quickly.

6) Shipping, Risk of Loss & Delivery

Processing Times. Orders typically process within 2 business days before shipment.

Transit Estimates (ship-from Charlotte, NC):
• East Coast: ~2 business days
• Central U.S.: ~3–4 business days
• West Coast, CA & HI: ~5–6 business days

These are estimates only and not guarantees.

Carrier Responsibility. Title and risk of loss transfer to you upon our delivery of the package to the carrier. Delays caused by carriers, weather, or events beyond our control are not our responsibility, but we will help with reasonable carrier follow-up.

Address Accuracy. You are responsible for entering a correct, deliverable shipping address. Returned/undeliverable shipments may incur reship fees.

Local Delivery. Not currently offered.

7) Returns, Exchanges & Damages

Please see our Refund/Return Policy for full details and timelines.

Custom/Corporate orders (see Section 8) are final sale and not eligible for return, except for manufacturing defects reported within the specified window in our policy.

If your order arrives damaged, contact us promptly with photos and your order number so we can assist with a carrier claim or replacement where applicable.

8) Custom & Corporate Orders (Logos, Personalization, Bulk)

For corporate gifting, logo application, or any customized items:

Proofs & Approvals. We provide digital proofs upon request or when required; production begins only after your approval. Your timely approvals affect lead times and delivery dates.

Intellectual Property Warranty. You represent and warrant that you have all rights to provide any logos, artwork, or content and that our use will not infringe any third-party rights. You grant us a non-exclusive license to use such content solely to complete your order and for internal archival.

Color/Material Variance. Minor variations can occur between proofs, screens, and final materials (e.g., print, engraving, ribbon, tissue).

Final Sale. Customized and bulk corporate orders are non-cancelable and non-returnable after approval.

Timeline. Production and shipping timelines are estimates; we will communicate promptly if constraints arise (supplier shortages, carrier delays, force majeure).

9) Gift Cards

Gift cards (physical or digital) are sold and redeemed in USD on our Site. They are not reloadable, cannot be redeemed for cash (except as required by law), and we are not responsible for lost, stolen, or unauthorized use. Treat gift cards like cash.

10) User Content; Reviews & Feedback

If you submit reviews, photos, suggestions, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display the User Content in any media for store operations and marketing, without obligation to compensate you. You are responsible for the content you share and must not violate any law or third-party rights. We may remove content at our discretion.

11) Acceptable Use

You agree not to use the Site:
(a) for unlawful purposes or to violate laws/regulations;
(b) to infringe intellectual property or privacy rights;
(c) to transmit malware, spam, scraping, or disruptive code;
(d) to misrepresent your identity or affiliation;
(e) to collect others’ personal information without consent;
(f) to interfere with security features or the Site’s operation.

We may suspend or terminate access for violations.

12) Third-Party Services & Links

The Site integrates third parties (e.g., Shopify, payment processors, shipping carriers, marketing and analytics tools). Your use of those services may be governed by their terms and privacy policies. We are not responsible for third-party websites or resources and make no warranties about them.

13) Communications: Email & SMS (Text Messaging)

Email. If you opt-in to marketing emails (e.g., via Klaviyo), you consent to receive promotional and cart/browse messages. You can unsubscribe using the link in any marketing email.

SMS. If you opt-in to SMS, you consent to receive autodialed or prerecorded marketing messages at the phone number you provide. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. Text STOP to unsubscribe and HELP for help. Carriers are not liable for delayed or undelivered messages.

14) Privacy

Your submission of personal information through the Site is governed by our Privacy Policy, which explains what we collect, how we use it, and your choices (including state-specific rights where applicable). Please review it carefully.

15) Intellectual Property

All content on the Site (including product photography, catalog copy, designs, logos, and trade dress) is owned by or licensed to Curated Comforts Co. and protected by intellectual property laws. You may not copy, reproduce, or exploit any Site content without our prior written consent.

16) Disclaimers

THE SITE, PRODUCTS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that results will meet your expectations.

17) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CURATED COMFORTS  (AND OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND PARTNERS) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS/REVENUES; LOSS OF DATA; OR REPLACEMENT COSTS, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, PRODUCTS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE PRODUCT(S) AT ISSUE DURING THE 3-MONTH PERIOD PRECEDING THE CLAIM.

Some jurisdictions do not allow certain limitations; in such cases, the foregoing limits apply to the maximum extent permitted.

18) Indemnification

You agree to defend, indemnify, and hold harmless Curated Comforts Co. and our affiliates, officers, directors, employees, agents, suppliers, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your breach of this Agreement, your misuse of the Site, or your violation of law or third-party rights.

19) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply chain interruptions, epidemics, carrier delays, or government actions.

20) Termination

We may suspend or terminate your access to the Site or cancel orders at any time for actual or suspected violations of this Agreement or for other legitimate business reasons. Sections that by their nature should survive (such as intellectual property, disclaimers, limitations, indemnity, and governing law) will survive termination.

21) Governing Law; Venue

This Agreement is governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of state and federal courts located in Mecklenburg County, North Carolina for any dispute not subject to small-claims court.

22) Entire Agreement; Severability; No Waiver

These Terms, together with policies referenced herein (e.g., Privacy Policy, Refund Policy, Shipping Policy), constitute the entire agreement between you and us regarding the Site and supersede prior understandings. If any provision is held invalid, the remaining provisions will remain in full force. Our failure to enforce any right is not a waiver.

23) Changes to the Terms

You can review the latest version of these Terms at any time on this page. We may update them by posting a revised version with a new “Effective Date.” Your continued use of the Site after updates means you accept the changes.
